SYMPOSIUM ON PROCESS AND REFORM: COMMISSION COMPLAINT PROCEDURES

PROCEDURES UNDER SECTION 211 ALSO NEED TO BE REFORMED.

The Working Group members focused their efforts on dispute resolution procedures under Section 206 of the Federal Power Act. EPSA believes that prompt resolution of certain other disputes, particularly those brought under Section 211, are equally necessary for the successful functioning of competitive markets. Section 211 cases go directly to the heart of the Commission’s open access policies. The ability of market participants to obtain transmission service is central to the Commission’s vision of workably competitive wholesale electric markets. When Section 211 complaints languish without resolution, transactions, business opportunity and market liquidity are all irreparably lost. EPSA urges the Commission to adopt comparable dispute resolution procedures for Section 211 filings as well.
