FOR THE REASONS SET FORTH HEREIN, EPSA respectfully requests permission to intervene in and become a party to this proceeding, and to be afforded all rights appropriate to that status. In addition, the Commission should clarify that Southern cannot require Generators to obtain back-up service under this tariff and, as discussed herein, modify the more onerous provisions of the proposed tariff to ensure that the development of competitive generation facilities in the Southeastern United States is encouraged, not discouraged.
