COMPLAINT REQUEESTING FAST TRACK PROCEDURES, PJM INTERCONNECTION, L.L.C.

REQUEST FOR FAST TRACK PROCEDURES

Pursuant to Rules 385.206(b)(11) and 385.206(h) of the Commission Rules of Practice and Procedures, the Complainants request Fast Track processing of this complaint so that this matter can be quickly resolved. Expeditious procedures are required because PJM is attempting to make its market rule change effective as of January 1, 2000. Accordingly, PJM might attempt to deny Market Sellers credits to which Market Sellers are entitled on any day (after January 1), that PJM declares a Maximum Emergency Generation Alert. Since the Complainants believe that the PJM change is ineffective prior to filing an acceptance or approval by the Commission, there will be substantial uncertainty as to the appropriate prices paid to generators for these Alert days. This price uncertainty could adversely affect the behavior of market participants and distort the economics of the PJM markets. It is in the interest of PJM and all market participants to have certainty on this matter as early as possible. Moreover, this matter involves a question of PJM's authority to take certain action related to rates - a matter that can be quickly resolved by the Commission.
