II. Arguments
A.CMUA’s Complaint
In this complaint the CMUA asks the Commission to suspend the market-based rate authority of jurisdictional sellers in the California markets and reinstate cost-of-service ratemaking for those sellers until “fundamental changes can be made” and the markets are found to be “workably competitive.”
In its Complaint, CMUA alleges that “it is beyond dispute that markets in California are not workably competitive.” CMUA supports this assertion with its belief that “California consumers are experiencing unprecedented, high, sustained wholesale power prices” and then concludes that only additional generation investment can fix this problem. CMUA notes that new investment is still “years away,” requiring the unprecedented Commission action of eliminating market-based rates and the re-imposition of cost-of-service rates.
