On September 21, 2000, Dunkirk Power, LLC, Huntley Power, LLC and Oswego Harbor, LLC, all affiliates of NRG Energy, Inc. (collectively, NRG) submitted a Petition for Declaratory Order requesting that the Commission issue an order declaring that NRG’s electric generation facilities have the right to treat station power as net/negative generation in a non-discriminatory manner.

NRG also requested that the Commission issue an order declaring that Niagara Mohawk Power Corporation (Niagara Mohawk) cannot require NRG’s generators to obtain station power under a retail tariff or resort to state law to terminate station power or shut down any NRG facility. In a Notice of Filing issued October 2, 2000, the Commission set October 20, 2000 as the deadline for timely interventions and protests.
