2. The Commission should limit the degree of influence and control Applicants propose to exercise over the initial GridFlorida Board selection process

By seeking expedited review of the independence and selection of GridFlorida employees and its Board, Applicants are also implicitly requesting expedited approval of the structure of GridFlorida, the composition of its Board and the scope of its authority. These measures will establish important “building blocks” with far-reaching implications on the effectiveness of an RTO in Florida. Issues regarding the appropriate scope of Board authority and levels of experience and expertise, and review of the degree and manner of assuring independence require closer and more deliberate scrutiny than the Applicants suggest. Commission action on this proposal requires review of all these related issues prior to their approval. Moreover, speed of implementation, and in this case, haste to set the foundation of the Florida RTO, should not override prudence. EPSA believes it is far better to address the issues identified in this filing prior to granting authority to select directors and hire GridFlorida employees.
