3. CONCLUSION

The Commission should take the opportunity presented by the CAISO MSP filing to clarify the nature of the CAISO Board’s role on a going-forward basis. As discussed above, the CAISO Board no longer meets the Commission’s requirements for independence and a new, independent Board should be seated. Further, the Commission should reject the CAISO’s MSP and focus instead on taking meaningful action that will provide a market structure that allows California to improve its energy supply problem, resolve remaining credit problems and allow the market to stabilize.
