REQUEST FOR CLARIFICATION OR IN THE ALTERNATIVE REHEARING OF THE ELECTRIC POWER SUPPLY ASSOCIATION AND THE WESTERN POWER TRADING FORUM

CONCLUSION

Unfortunately, the price mitigation measures put forth in the June 19th Order will do little if anything to solve the problems facing California’s electricity markets, and will, in fact, discourage needed investment by creating regulatory uncertainty and enhancing risk. However, if the Commission imposes the mitigation measures contained in the June 19th Order, certain clarifications or, in the alternative, rehearing is needed. As outlined herein, the Commission should clarify certain aspects of its Order to provide maximum certainty and much needed stability to market participants.
