MOTION FOR LEAVE TO INTERVENE AND PROTEST OF THE ELECTRIC POWER SUPPLY ASSOCIATION re: SeTRANS PETITION

INTRODUCTION

In the Petition, SeTrans Participants seek a declaratory order from the Commission determining that the proposed governance structure and business model of the anticipated SeTrans RTO, and its makeup of an Independent System Administrator (ISA), Stakeholder Advisory Committee (SAC), Independent Transmission Companies (ITCs) and Independent Market Monitor (IMM), satisfy the criteria set forth in Order No. 2000 and subsequent Commission criteria. SeTrans also seeks the Commission’s acceptance that the process by which the SeTrans ISA is to be chosen satisfies the Order No. 2000 and subsequent criteria. Finally, the Sponsors seek a determination that the organic documents included with the Petition support the proposed governance structure and are consistent with the purposes of Order No. 2000 and subsequent Commission precedent. The Petitioners seek a Commission response by October of 2002.
