MOTION FOR LEAVE TO INTERVENE AND PROTEST OF THE ELECTRIC POWER SUPPLY ASSOCIATION re: CINERGY SERVICES, INC. ON BEHALF OF PSI ENERGY, INC., CINCAP MADISON, LLC AND CINCAP VII, LLC

MOTION TO INTERVENE

EPSA is the national trade association representing competitive power suppliers, including independent power producers, merchant generators and power marketers. These suppliers, who account for more than a third of the nation’s installed generating capacity, provide reliable and competitively priced electricity from environmentally responsible facilities serving global power markets. EPSA seeks to bring the benefits of competition to all power customers.

Certain EPSA members presently own, or are currently developing, generating projects in the Cinergy service area. EPSA is interested in protecting the rights of these power suppliers to compete on fair and non-discriminatory terms with Cinergy’s generating facilities, including the facilities proposed to be sold by CinCap Madison and CinCap VII to PSI. Accordingly, EPSA has a direct and substantial interest in the outcome of the instant proceeding, which cannot adequately be represented by any other party.
