MOTION FOR LEAVE TO INTERVENE AND PROTEST OF THE ELECTRIC POWER SUPPLY ASSOCIATION re: SOUTHERN POWER COMPANY

MOTION TO INTERVENE

EPSA is the national trade association representing competitive power suppliers, including independent power producers, merchant generators and power marketers. These suppliers, who account for more than a third of the nation’s installed generating capacity, provide reliable and competitively priced electricity from environmentally responsible facilities serving global power markets. EPSA seeks to bring the benefits of competition to all power customers.

Certain EPSA members presently own, or are currently developing, generation projects in the Southern control area or in adjacent regions that are deliverable to the Southern control area. EPSA is interested in protecting the rights of these power suppliers to compete on transparent, fair and non-discriminatory terms with Southern’s own generating facilities, including the facilities which are proposed as counterparties to the PPAs. In addition, as transmission customers under the Southern OATT, EPSA’s members pay rates for ancillary services that are based on the costs of Entergy’s generation portfolio. Accordingly, EPSA has a direct and substantial interest in the outcome of the instant proceedings, which cannot adequately be represented by any other party.
