REQUEST FOR REHEARING OF THE ELECTRIC POWER SUPPLY ASSOCIATION re: AMEREN ENERGY GENERATING COMPANY AND UNION ELECTRIC COMPANY d/b/a AMERENUE

BACKGROUND

On February 5, 2003, Ameren Generating Company (AEG) and Union Electric Company d/b/a AmerenUE (Applicants or Ameren) filed an application requesting authorization to transfer from AEG, an exempt wholesale generator, to AmerenUE, a public utility operating company affiliate of AEG, jurisdictional facilities associated with certain generating assets that are also to be sold by AEG to AmerenUE. On February 26, 2003, alarmed by the serious threat to competitive markets posed by this transfer, EPSA filed an intervention and protest (Protest). EPSA’s filing urged the Commission to evaluate the proposal as it would a long-term power purchase agreement (PPA) between affiliates, with specific reference to its impact on competition, and to apply a “market test” analysis as it outlined in Edgar. EPSA further highlighted the Applicants’ failure to meet its burden of establishing that their proposal is the most reliable, efficient and economic option, or otherwise showing that it offered a better deal for AmerenUE’s ratepayers then they could have received from non-affiliate suppliers.
