Motion for Leave to Intervene and Comments of the Electric Power Supply Association re: AES Somerset, LLC v. Niagara Mohawk Power Corporation
Background
On June 25, 2003, AES Somerset, LLC (Somerset) filed a complaint with the Commission against Niagara Mohawk Power Corporation (Niagara Mohawk) seeking an order that prohibits Niagara Mohawk from unlawfully charging Somerset for station power service. According to the Somerset complaint, Niagara Mohawk has attempted to bill the 675 megawatt coal-fired electric generating facility in Somerset, N.Y., for station power service that Niagara Mohawk alleges to have provided the facility from April 2000 to March 2003. Somerset has explained to Niagara Mohawk personnel that it self supplies its station power requirements on a monthly net basis. Niagara Mohawk has stated its intention to continue billing Somerset for said power.
