Pursuant to Sections 212 and 214 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission (FERC or Commission), 18 C.F.R. § 385.212 and 214, the Electric Power Supply Association (EPSA) respectfully files this motion for leave to intervene and comment in the above-captioned proceeding. On July 25, 2003, the Midwest Independent Transmission System Operator, Inc. (MISO) filed with FERC its Open Access Transmission and Energy Markets Tariff (TEMT) in compliance with the Commission’s February 24, 2003 Declaratory Order. EPSA is encouraged by the filing and supports the steps the MISO proposes to implement workable, efficient energy markets in the Midwest. However, strong and detailed guidance from FERC is needed if certain issues are to be resolved successfully. EPSA urges FERC to provide clear direction so that on a number of critical policy issues MISO stakeholders can continue with their consensus building process to develop workable solutions on important aspects of MISO market development.
