Intervention and Request for Comment of EPSA re: Southwest Power Pool Inc.

Background

On October 13, 2000, pursuant to Order No. 2000, SPP filed its RTO proposal with the Commission (Docket No. RT01-34). On November 20, 2000, EPSA filed a Motion to Intervene and Protest, asserting, that among other things, the extensive grandfathering of existing transmission uses for native load in SPP’s proposal raised comparability issues and would obstruct the growth of non-discriminatory open access. EPSA also intervened and protested the Entergy proposal (Docket No. RT01-75) to become an Independent Transmission Company under SPP.

On March 28, 2001, the Commission issued an Order in Docket Nos. RT01-34 and RT01-75 finding that SPP failed to satisfy its scope and configuration requirements. SPP’s May 25, 2001 filing was not significantly different from the original October 13, 2000 filing and, the key concerns EPSA raised in its Motion to Intervene and Protest remained unresolved. On June 18, 2001, EPSA reiterated the reasons for the Commission to reject SPP’s May 25, 2001 filing.

SPP and its stakeholders have spent significant time and effort developing an RTO proposal. Therefore, EPSA is pleased that over the last two years SPP has addressed many of EPSA’s previous concerns, and now has embarked on a meaningful stakeholder process complete with milestones. While there are still some aspects of the filing that need further detail, the filing is an encouraging step forward for competitive wholesale market development.
