Pursuant to Rule 214 and 713 of the Rules of Practice and procedure of the Federal Energy Regulatory Commission (FERC or Commission), 18 C.F.R. §§ 385.214, and 713, the Electric Power Supply Association (EPSA) respectfully files this motion for leave to intervene out of time in the above-captioned proceeding, and hereby submits this request for clarification of the Commission’s November 17, 2003 Order eliminating regional through and out (T&O) rates of the Midwest ISO (MISO) and PJM . As a trade association representing competitive power suppliers, EPSA promotes the adoption of clear, consistent rules governing wholesale power markets. Thus, EPSA respectfully requests the Commission clarify how transmission providers are to treat requests for transmission service that are received prior to April 1, 2004 for service that is not scheduled to begin until on or after April 1, 2004, and which would source and sink within the combined region.
