Pursuant to Rules 212 and 713 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission (FERC or Commission), 18 C.F.R. §§ 385.212 and 385.713, the Electric Power Supply Association (EPSA) hereby submits this request for clarification, or in the alternative, rehearing, of the Commission’s November 17, 2003, Order Amending Market-Based Rate Tariffs and Authorizations (November 17 Order). In that Order, the Commission outlined six market behavior rules that will become a condition of market-based rate authority. For the reasons explained below, EPSA respectfully requests that the Commission clarify certain language contained in the market behavior rules.
