Motion for Clarification and/or Rehearing of EPSA re: Investigation of Terms and Conditions of Public Utility Market-Based Rate Authorizations
Introduction
On November 17, 2003, the Commission issued a final order in this proceeding, incorporating extensive comments from numerous interested parties on the proposed Market Behavior Rules. EPSA supports and appreciates the Commission’s consideration of numerous comments and alternative language in offered to develop clear, well designed behavioral rules that provide proper notice to parties as to what constitutes acceptable and unacceptable behavior consistent with Commission-approved market structures. While the rules are vastly improved and largely achieve the stated goals of the Commission and market participants, there are a few discrete clarifications that are necessary to ensure that the rules properly reflect the Commission’s intent as described in the November 17 order.
