Comments of EPSA on Southern Power Co.'s Request to Withdraw its McIntosh PPAs

Conclusion

WHEREFORE, for the reasons set forth above, EPSA respectfully requests that the Commission, under its authority granted by Section 206 of the FPA, continue with the hearing process in this docket in order to investigate allegations of affiliate abuse which remain within the scope of this docket but fall outside of the disposition of the McIntosh units or the withdrawal of the McIntosh PPAs. As the Commission recognized in the recent Mountainview proceeding, such alleged abuses have a detrimental impact on competitive wholesale markets and would require remedy from the Commission.
