FOR LEAVE TO INTERVENE AND COMMENT

Pursuant to Sections 212 and 214 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission (FERC or Commission), 18 C.F.R. § 385.212 and 214, the Electric Power Supply Association (EPSA) respectfully files this motion for leave to intervene and comment in the above-captioned proceeding. In the wake of the suspension of SeTrans in December of 2003, Entergy proposes changes to its open access transmission tariff (OATT) with a goal of achieving greater independent oversight of the operation of its transmission system, and greater efficiency in pricing and providing transmission service. Entergy will also provide the Commission and state regulators with reports from an independent transmission entity. The changes propose an Independent Coordinator of Transmission (ICT) to be the independent transmission entity. While EPSA supports Entergy’s goals, this filing is inadequate and flawed. The Commission should order Entergy to join SPP and reject the ICT as proposed, or condition the proposal to fix specific errors if the ICT is to serve as an interim step to Entergy’s integration into an RTO.
