EPSA's Motion for Leave to Comment on Southern Company Services, Inc (SCS) Compliance Filing
CONCLUSION
WHEREFORE, EPSA respectfully requests that the Commission, finding that Southern has failed the indicative generation market power screens, initiate a Section 206 proceeding to investigate the rebuttable presumption that Southern has market power in its control area. In the interim, Southern Companies’ market power must be addressed through structural mitigation tools that will facilitate competitive markets and address Southern Companies’ market power.
