CONCLUSION
WHEREFORE, EPSA respectfully requests that the Commission, finding that Entergy has failed the market power test, initiate a Section 206 proceeding to investigate the rebuttable presumption that Entergy has market power in its control area. In the interim, Entergy’s market power must be addressed through structural mitigation tools that will facilitate competitive markets and address Entergy’s market power.
