EPSA's Answers In Support of PSEG Energy Resources & Trade LLC's Request for an Extension of Time

Pursuant to Rule 213 of the Federal Energy Regulatory Commission’s (FERC or Commission) Rules and Regulations, the Electric Power Supply Association (EPSA) hereby files this Answer in support of PSEG Energy Resources & Trade LLC’s (PSEG) request for a one week extension of the comment deadline in the above-captioned dockets from March 3 to March 10. As explained in PSEG’s filing, due to the importance of protecting confidential market information while allowing reasonable access to parties with a legitimate interest in it, numerous EPSA members have actively participated in the stakeholder effort to reach a consensus on this subject. Unfortunately, the offers of proof that the Organization of MISO States’ (OMS) filed on February 11, 2005 indicate that this effort has not been as productive as expected, and disagreements on certain fundamental issues remain that must be addressed.

ACCORDINGLY, EPSA respectfully requests that the Commission grant an additional week for all interested parties to more adequately assess the OMS’ response to the Commission’s “Confidentiality Order” of September 30 in Docket Nos. ER04-691-003 and EL04-003.
