EPSA's Motion to Intervene and Comment in Support of Complaint of Michigan QFS

Preface

Pursuant to Rules 212 and 214 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission (Commission), 18 C.F.R. §§ 385.212, 385.214 (2003), the Electric Power Supply Association (EPSA) hereby moves to intervene and file comments in this proceeding.

EPSA supports the right of the eight Michigan qualifying facilities (Michigan QFs) in this proceeding, the complainants, to enforce the terms of their long-term power purchase agreements with Consumers Energy Company (Consumers) pursuant to the Public Utility Regulatory Policies Act (PURPA), 92 Stat. 3117, 15 U.S.C. § 321, et. seq., 16 U.S.C. 824a-3, et seq, and the Commission’s implementing regulations, 18 C.F.R. Part 292.
