EPSA's Comments and Motion to Intervene in Duke's ITE Proposal

Motion to Intervene

EPSA is the national trade association representing competitive power suppliers, including generators and marketers. These suppliers, who account for 40 percent of the installed generating capacity in the United States, provide reliable and competitively priced electricity from environmentally responsible facilities serving global power markets. EPSA seeks to bring the benefits of competition to all power customers.
EPSA members own significant generating assets in the Eastern Interconnection. Given the extent of these investments and the significance of non-discriminatory transmission system access, or lack thereof, to the commercial viability of these investments, EPSA and its members have been commenting parties in similar Independent Transmission Entity (ITE) proceedings such as Entergy’s ICT proposal (Docket No. ER05-1065-000). EPSA has a direct and substantial interest in the development of policy concerning this and similar ITE proposals because the manner in which vertically integrated utilities transition beyond Order No. 888 will directly effect the success of a competitive generator’s business. Accordingly, EPSA has a direct and substantial interest in the outcome of this proceeding that cannot be adequately represented by any other party.
