EPSA's Joint Protest on Alliant Petition
Conclusion
WHEREFORE, Joint Parties urge the Commission to reject Alliant’s petition based on the discussion above, and provide guidance on the criteria to be relied upon by the Commission when making future determinations on applications for relief of the PURPA purchase obligation as set forth in § 210(m) of the Public Utility Regulatory Policies Act of 1978, as amended (“PURPA”), 16 U.S.C. § 824a-3(m).
