Statement of Issues
A. EPSA makes a motion to intervene and comment in this docket, and otherwise meets the standards for comment and intervention under 18 CFR § 385.211 and 385.214 (2004).
B. The Commission should dismiss the instant complaint and move forward with the consideration and approval of the LICAP capacity market mechanism. The complaint is unfounded and fueled by rhetoric rather than market fundamentals.
