EPSA Statement On Pro-Competition Federal Appeals Court Decision Today
WASHINGTON, D.C. - Electric Power Supply Association (EPSA) President and CEO John E. Shelk issued the following statement on today's decision by a unanimous three judge panel of the United States Court of Appeals for the Ninth Circuit upholding the legal authority of the Federal Energy Regulatory Commission (FERC) to implement a market-based rate policy through issuance of FERC's Order 697:
"EPSA intervened in this important case to support FERC's authority to permit competitive wholesale power suppliers to sell electricity at market-based rates. EPSA is pleased with today's decision, which is consistent with prior decisions by the Ninth Circuit and the D.C. Circuit federal courts of appeals.
Market-based rates are the cornerstone of competitive wholesale electricity markets nationwide. These competitive wholesale power markets continue to provide meaningful benefits to consumers, the economy and the environment. The court in this case wisely recognized the significant steps FERC took in Order 697 to further strengthen federal oversight of market-based rate sellers to meet FERC's obligations under the Federal Power Act."
