EPSA Welcomes Court Review And EPA Reconsideration Of Backup Generator Rule
WASHINGTON, D.C. - The Electric Power Supply Association (EPSA) today welcomed this week's filings (April 1, 2013) by a wide range of interests seeking federal appellate court review and agency reconsideration of January 2013's final rule exempting backup generators compensated as "demand response" from hazardous air pollution regulations.
"EPSA is impressed that three petitions for review by the U.S. Court of Appeals for the District of Columbia Circuit were filed by the State of Delaware Department of Natural Resources and Environmental Control, the Conservation Law Foundation, and jointly by three suppliers of environmentally responsible electricity, PSEG, Calpine and First Energy," said John E. Shelk, EPSA President and CEO.
"Equally as impressive as the court petitions is a petition for administrative reconsideration filed with EPA by a group of eight national, state and local environmental groups," Shelk continued, noting that a petition for administrative reconsideration was also filed jointly by Calpine and PSEG.
"EPSA continues to stress that the January 2013 EPA final rule exempting backup generators from emissions rules combined with how wholesale electricity markets are conducted in the Northeast means that demand response propped up by diesel generators displaces cleaner power generation," Shelk stated. "Ample evidence to document the displacement of cleaner power generation by these backup generators was presented to EPA in this docket. Only those seeking to profit without meeting the air rules the rest of us comply with stand to benefit. The losers are public health, the environment and responsible power suppliers."
