Why can't states do this on their own?

The states can do much of this on their own, and some already are. However, only Congress can guarantee that all customers enjoy the cost-saving benefits of customer choice. EPSA believes Congress should do just that by requiring all states to allow customers to choose among competing suppliers. Congress should also establish basic guidelines for such competition, while leaving the details of competition to the states. If Congress does not create a national market for electricity sales, consumers will be the losers. Electricity has long been bought and sold across state borders because of the savings gained from such transactions. Unless Congress sets a date by which all states must allow competition, those potential savings will be jeopardized. Indeed, we have already seen that some states are embracing competition and others are not. Such a fragmented market will undermine the savings benefits only vibrant, nationwide competition can bring.
